Policy Regarding Blind Persons Operating
Vending Facilities and First Right of
Refusal
This
State passed the Blind Persons Operating Vending Facilities Act to provide blind
persons with remunerative employment, to enlarge their economic opportunities,
and to stimulate efforts in striving to make themselves self-sufficient. This
Administrative Order shall set the policy for this administration in support of
the act and clarify the preference given to blind persons to operate vending
facilities on all State property.
The purpose of this Administrative
Order is to ensure that licensed blind vendors of the State of
Illinois
, through the Department of Human
Services Business Enterprise Program for the Blind, are given preference in
operating vending facilities as provided for under the Blind Persons Operating
Vending Facilities Act.
Policy
Licensed blind vendors of the State of Illinois, through the Department of
Human
Services Business Enterprise Program for the Blind are entitled through a
preference to operate vending facilities on all State property when it is determined that such vending facility can be properly and satisfactorily
operated by those licensed vendors. State government agencies must
annually submit to the Department of Human Services Business Enterprise Program
for the Blind an accounting of all vending facilities on their respective
properties and evidence of their compliance with the Blind Persons Operating
Vending Facilities Act.
No
Illinois
State
department, agency or
instrumentality shall in any way unreasonably limit the placement or operation
of a blind vending facility on property it administers, and no unreasonable
commission, rent, utility, charge or other service charge shall be imposed upon
a blind vendor by such department, agency or instrumentality.
Licensed blind vendors operating vending facilities pursuant to this
Administrative Order, or under the Blind Persons Operating Vending Facilities Act shall, to the maximum extent reasonable, hire individuals with disabilities
for employment in such vending facilities.
No State department, agency or instrumentality may in any way compete
with a
licensed blind vendor, nor otherwise take affirmative measure to limit the
placement or operation of a blind vending facility.
Nothing in this Administrative Order shall be construed as expanding or
limiting
the rights as provided for under the Blind Persons Operating Vending Facilities
Act or the Federal Randolph-Sheppard Act. Exceptions to this policy may be
made for current contractual obligations, facilities under the control or authority of the Historic Preservation Agency or the Department of Natural
Resources, and/or renewing or entering into vending contracts with Not-for-Profit Organizations and or Foundations. |
